Description: This book is designed to introduce the law student to the problems of pleading and joinder in civil actions. The combination of pleading and joinder in one course is not new; on the contrary it is traditional. But the separation of the pleading material from the joinder material departs from orthodox practice. The validity of this departure becomes clear when it is recalled that the provisions for joinder of claims and parties are concerned very largely with the compass or scope of the civil action. The problems of scope are entirely different from the problems which arise under rules that govern the manner of stating claims and defenses. These materials are divided into four parts. Part One deals with the rules of pleading now in force under current statutes and court rules. No attempt is made to distinguish among common law, equity, code, or federal practices; the rules of pleading are dealt with as a single system. Part Two deals with four systems of joinder of claims and parties: common law, equity, code, and federal. This treatment is necessary because there is no one system of joinder. Part Three relates to pre-trial objections to pleadings and joinder and follows the plan of Part One. Part Four contains text and cases on the forms of action, which can be employed either as reference materials or as the basis of specific instruction in the common law forms. The text emphasizes the substantive conditions of relief; the cases are arranged to show the historical development of the forms. If these materials are included in the course of study, the entire book can be covered in four semester hours. Without these materials, three semester hours will suffice. In Part Four also are the complete texts of the pertinent sections of the New York Field Code of 1848 (as amended to 1853) and the Federal Rules of Civil Procedure.
